These Terms and Conditions govern your use of our website and services, including bookings of artists and entertainers, and representation services. By using our services, you agree to comply with and be bound by these Terms and Conditions. If you do not agree to these Terms and Conditions, you must not use our services.
For the purposes of these Terms and Conditions:
The Company provides bookings for artists and entertainers, as well as representation services for talent. Each booking or representation deal is subject to a separate contract outlining the specific terms, conditions, and percentages agreed upon by both parties.
By accessing and using our website, you agree to comply with these Terms and Conditions and our Privacy Policy. You agree not to use the website for any unlawful purpose or in any way that might harm, damage, or bring disrepute to the Company.
All bookings and representation services are subject to individual contracts, which will outline the specific terms, conditions, and percentages for each deal. These contracts are legally binding and must be agreed upon by both the Company and the Client before any services are rendered.
Payment terms, including fees, percentages, and payment schedules, will be detailed in the individual contracts. The Client agrees to pay the Company according to the terms specified in each contract. Late payments may incur additional charges as outlined in the respective contract.
Cancellation and refund policies will be specified in the individual contracts. The Client agrees to the terms of cancellation and refunds as outlined in each contract. Any deposits or advance payments made are subject to the terms of the contract.
The Company will not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the service; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein; (iii) any interruption or cessation of transmission to or from our services; (iv) any bugs, viruses, trojan horses, or the like that may be transmitted to or through our services by any third party; (v) any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the services; and/or (vi) the defamatory, offensive, or illegal conduct of any third party. In no event shall the Company, its directors, employees, or agents be liable for any claims, proceedings, liabilities, obligations, damages, losses, or costs in an amount exceeding the amount you paid to the Company hereunder.
The Client agrees to defend, indemnify and hold harmless the Company, its affiliates, and their respective directors, officers, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney’s fees) arising from: (i) your use of and access to the Service, including any data or content transmitted or received by you; (ii) your violation of any term of these Terms and Conditions, including but not limited to your breach of any of the representations and warranties; (iii) your violation of any third-party right, including without limitation any right of privacy or intellectual property rights; (iv) your violation of any law, rule, or regulation of the United Kingdom, the United States, or any other country; (v) any claim or damages that arise as a result of any of your user content or any that are submitted via your account; or (vi) any other party’s access and use of the Service with your unique username, password, or other appropriate security code.
These Terms and Conditions and any contracts formed under them are governed by and construed in accordance with the laws of the United Kingdom. For Clients operating in the United States or other countries, these Terms and Conditions and any contracts will be governed by the applicable laws of the respective jurisdiction. Any disputes arising from or related to these Terms and Conditions or the services provided by the Company will be subject to the exclusive jurisdiction of the courts of the United Kingdom, the United States, or the respective jurisdiction.
The Company reserves the right to amend these Terms and Conditions at any time. Any amendments will be posted on our website and will take effect immediately upon posting. Your continued use of our services after any amendments constitutes your acceptance of the new Terms and Conditions.
